Article 1 — Applicability
1. These general terms and conditions apply to all agreements between Zangschool010 (hereinafter: "the singing school") and the student (hereinafter: "the student") regarding singing lessons, group lessons, workshops and related services.
2. By registering via the website, email, WhatsApp or any other means of communication, the student declares to have read and agreed to these general terms and conditions.
Article 2 — Registration and formation of agreement
1. You can register and start singing lessons at any time of the year.
2. The agreement is formed when the student registers for a trial lesson or lesson series via the website, email or any other means of communication, and the singing school confirms the registration.
3. We always start with a trial lesson where we get to know each other and discuss your wishes and goals. The trial lesson costs €25.
Article 3 — Right of withdrawal (cooling-off period)
1. When the agreement has been concluded at a distance (for example via the website, email or WhatsApp), the student has the right to dissolve the agreement within 14 days of concluding the agreement without giving any reason (right of withdrawal).
2. By booking a trial lesson or lesson, the student expressly requests that the service delivery begins within the 14-day cooling-off period.
3. When the student exercises the right of withdrawal, the student owes an amount proportional to the part of the service that has already been delivered at the time of dissolution. This means that lessons already taken (including the trial lesson) will be charged in full.
4. To exercise the right of withdrawal, the student must unambiguously communicate this by email to diede@diedemusic.com.
5. The singing school will confirm receipt of the dissolution by email.
Article 4 — Singing lessons
1. You can choose weekly or bi-weekly lessons. We agree on a fixed lesson time and schedule the lessons structurally.
2. If you cannot attend a lesson time, we will do our best to reschedule. However, the lesson must be made up within the same calendar month. A maximum of one lesson per month can be rescheduled.
3. There is no guarantee that making up a lesson with the same teacher will be possible. If the lesson time cannot be rescheduled, you will have the option to schedule a lesson with another teacher or receive a digital lesson.
Article 5 — Cancellation
1. The agreement can be cancelled by the student with a notice period of one full calendar month.
2. Example: if you cancel on May 7th, the agreement continues until June 30th.
3. Cancellation must be sent by email to diede@diedemusic.com.
4. The right of withdrawal (Article 3) is separate from regular cancellation and applies exclusively within 14 days of concluding the agreement.
Article 6 — Payment
1. Payment is made monthly. The student receives an invoice before the start of the new month with the scheduled lessons.
2. For students aged 21 and over, 21% VAT is charged. Students under 21 are exempt from VAT.
3. The invoice must be paid within 14 days of the invoice date, stating the invoice number.
4. In case of late payment, the singing school reserves the right to suspend lessons until payment has been made.
Article 7 — Teacher absence
1. When the teacher is unable to attend, an alternative lesson time will be arranged together.
2. If this is not possible, the student will receive a digital lesson. If this is also not possible, the lesson will be credited to the next calendar month.
Article 8 — Student absence
1. When cancelling 48 hours or more before the lesson time, a make-up time will be arranged together. There is no guarantee this will be with the same teacher.
2. When cancelling less than 48 hours before the lesson time, the lesson will be charged in full.
Article 9 — Holidays
1. The singing school does not follow fixed school holidays.
2. Holidays or extended absences must be communicated at least one month in advance so that the lesson schedule can be adjusted accordingly.
Article 10 — Rates and price changes
1. Current rates are listed on the singing school's website.
2. The singing school reserves the right to adjust rates annually. Rate changes will be announced at least one month in advance.
Article 11 — Liability
1. The singing school is not liable for damages of any kind, unless there is intent or gross negligence.
2. Participation in lessons and activities is at the student's own risk.
Article 12 — Applicable law and disputes
1. These general terms and conditions are governed by Dutch law.
2. Disputes are preferably resolved by mutual agreement. If this is not possible, the competent court in Rotterdam has jurisdiction.
Article 13 — Amendment of conditions
1. The singing school reserves the right to amend these general terms and conditions. Amended conditions will be published on the website.
2. By continuing lessons after amendment of the conditions, the student accepts the amended conditions.
